SAG-AFTRA filed a motion in federal court Wednesday to dismiss the suit filed by Ed Asner and other regarding residuals and foreign royalties. The motion argues that the state causes of action in the suit are preempted by federal labor law, and that a cause of action for examination of books and records is premature.
Even if the motion is granted, it’s unclear whether the plaintiffs in the suit could once again amend their complaint and resubmit.
A hearing is scheduled for January 6.
