Since the massive police shootout in Roseville, the suspect’s family, friends and neighbors have argued that Sammy Duran never fired the first shot. Then they shared with FXO40 video from the scene that had never been seen before.

The cell phone video was taken just moments after an ICE agent got shot.

“It was like a fire range out here, like a battle zone,” said suspect’s aunt Donna Sandoval.

The first shooting happened in front of Sammy Duran’s aunt’s house on Windsor Drive. Donna Sandoval maintains one officer shot the other.

“I walked out the door and bullets were already flying. I seen the officer on the ground and I heard him say I’ve been shot and I asked him, ‘Are you okay?'” said Sandoval.

Duran’s other aunt, visiting from New York for her mother’s 91st birthday, says she witnessed everything from a kitchen window.

“Well, I know I saw one of the agents, he shot one of his agents and I said, ‘Oh my God, he’s going down.’ And then my nephew he came and said, ‘You shot your own man. Why did you shoot him?'” said Duran’s aunt, Maria Shallert.

A neighbor also told FOX40 what he witnessed.

“From my point of view and from what I seen, that officer had to shoot the because there was no way the other dude even have time to do that. He was too busy running. He was on a full on sprint,” he said.

But Roseville Police Chief Daniel Hahn says one officer did not shoot the other, for evidence points to Duran being the shooter.

“So far, all of the evidence that we have collected so far does not point to that. There is no evidence that we have seen so far that would lead to believe that other than he being shot by the suspect,” Hahn said.

Duran, who is being held at Placer County Jail, has declined requests for an interview.
