Rolling Hills Elementary in Fairfield school is a place where kids go to learn, but one fourth grader says he’s a victim of a bully.

“He came up and pushed me, I pushed him back and he punched me in the face and he said ‘Haha, you got punched,'” the boy said.

We aren’t releasing the child’s name to protect his identity. He says he doesn’t share a classroom with the 9-year-old, but his alleged tormentor still finds away to come after him.

“He uses the n-word, b word, the s-word many times,” he said.

The Feudner family is fuming, saying the harassment has gone on for five months.

That’s why Stephen Feudner, the boy’s father, says he had no choice but to file a restraining order also known as a civil harassment order against a 9-year-old child.

Even the Solano County Sheriff’s Department said they’d never heard of an order being placed on someone so young, but said it’s possible.

“He’s attacked my son and other children. I am trying to protect them from future attacks by this young man,” Feudner said.

In a few days the order will be null and void, because the school refuses to give up the boys full name and his address.

FOX40 reached out to the Fairfield-Suisun Unified School district and this is there response: “The school district is aware that Mr. Feudner wanted information for a student at Rolling Hills Elementary School. It’s not our policy to release the address or information from one family to the next.”

As of right now, if the Feudners don’t track down the family of the other boy; the order won’t stand.
