EL DORADO COUNTY-

El Dorado County Board of Supervisors is considering throwing out County Ordinance 5000, the law allowing county residents to grow their own marijuana outdoors for personal medicinal use.

Pushing for the change is Supervisor Ron Briggs. Although he signed County Ordinance 5000 into law last September, he will ask fellow Supervisors to repeal the ordinance at Tuesday’s public meeting.

In his master report, he sites increased illegal and criminal activity, environmental concerns, and nuisance as the many reasons for his proposal for repeal.

However, not everyone agrees to the proposal.

Matt Vaughn is a glaucoma patient and pot user. As president of the Medical Marijuana Caregivers Association, he believes the only law breakers are the law makers.

“It’s just outrageous to say that the county is no longer following state law,” Vaughn said.

Vaughn said if the repeal is enacted, it will not only inconvenience seriously ill patients, it will not stop him from helping others.

“We still have our first amendment right to assemble out here. We are an association, so they’re not going to close our doors,” he said. “I don’t see it going any place. Legally, I don’t see it going any place. If they do enact something, there are attorneys waiting to sue them. They really kicked the hornets nest here, they’re going to see quite a backlash tomorrow.”

FOX40 contacted the County several times. Supervisor Briggs was unavailable for comment. Sheriff John D’Agostini declined our interview request.
