Manuel Rodriguez and Edgar Gonzalez were charged with murder in September 2013 for the fatal shooting of Vidal Reyes Montiel in Live Oak on Aug. 31, 2013.

A Sutter County judge dismissed a gang-related murder case due to lack of evidence.
Manuel Rodriguez and Edgar Gonzalez were charged with murder in September 2013 for the fatal shooting of Vidal Reyes Montiel in Live Oak on Aug. 31, 2013.
Superior Court Judge Chris Chandler agreed to Deputy District Attorney Cameron King's motion to dismiss the case on Tuesday.
The prosecution has been unable to locate a vital witness, according to court documents. That witness allegedly told officers he saw the shooting, according to Gonzalez's defense attorney, Rick Worrell.
King did not respond to requests for comment by email and phone.
Worrell said even if the witness were found, Gonzalez would be acquitted because the witnesses would not be credible.
"I believe there was multiple problems with the people's case," Worrell said. "Not just the absence of a single witness."
After a year in custody at the Sutter County Jail, Rodriguez was released Tuesday.
Gonzalez was released into custody of immigration and naturalization services. He had been arrested in 2009 and charged with a felony in relation to graffiti. That case was also dismissed due to insufficient evidence.
