A Marysville man threatened to kill his wife then showed up where she was staying with a loaded assault rifle. Prosecutors say he would have used the AR-15 if a deputy had not stopped him.
Dustin James Santos was charged with attempted murder after he called his wife, with whom he has three children, and threatened to come to her parents' house on Ninth Avenue and shoot them.
Ten minutes later, he arrived in his car and was arrested by Yuba County sheriff's deputies, according to an officer affidavit.
Deputies found a loaded AR-15 rifle in his trunk. Back at the department, Santos, 28, allegedly admitted he had battered his wife the day before, and he put the rifle in his car after he threatened her.
The decision to file a charge of attempted murder was "based on the facts, and the way it was escalating," said Deputy District Attorney Rory McBryde, who filed the criminal complaint Wednesday.
"It looked like that was the direction it was going," he said.
Santos was also charged with corporal injury of a spouse, criminal threats and carrying a loaded firearm with the intent to commit a felony.
He appeared in court Wednesday but did not enter a plea. He said he planned to hire a private attorney and was scheduled to return to court Thursday, court documents say.
He remains in the Yuba County Jail with bail set at $500,000.
