HKPDA survey on 2016 Proposed Changes to the Medical Registration Ordinance
The Government has put forward a proposal to introduce certain changes to the Medical Registration Ordinance (MRO, Cap 161). The purpose is to “increase the number and enhance the role of lay members and assessors of the (Medical) Council and to empower the (Medical) Council to approve application for limited registration for a longer period; so as to provide the Council with more flexibility to improve the complaint investigation and disciplinary inquiry mechanism and to facilitate the admission of non-locally trained doctors, respectively.”

Reference is also made to a recent High Court case, “in which the judge severely criticized the delay by the (Medical) Council in handling of complaints, there has been mounting public pressure for urgent improvements to be made to the operation of the Council in conducting disciplinary hearings.”

1. I support to increase the number of lay Council Members in the MCHK. This is to enhance accountability to the public.
2. I support to increase the number of medical Council Members in the MCHK. This is to enable the MCHK to set up more than one PIC and to cater for meeting quorum requirement to handle appeals and various inquiries more efficiently.
3. I support to maintain the ratio of Council members to be appointed by the Chief Executive of the HKSAR and elected by the profession at 1:1. This is to uphold the provision by Article 142 of the Basic Law and to maximize professional autonomy.
